Are THC Drinks Legal in Your State? The 2026 Guide
Federal law is the floor, not the ceiling. States can -- and increasingly do -- set their own, stricter rules for hemp-derived THC beverages. Here's what actually determines whether San Buzi can ship to you.

Start with the federal baseline
Hemp-derived Delta-9 THC beverages, San Buzi included, are federally legal under the 2018 Farm Bill as long as they stay within the hemp definition in effect at the time. That federal baseline is itself changing — see our explainer on the 2026 hemp beverage ban for what’s coming and when. But federal legality has only ever been the starting point. States are free to be more restrictive than federal law, and a growing number of them are.

Five ways a state can handle hemp beverages
Not every state handles this the same way. Broadly, a state falls into one of five buckets:
- Open — hemp-derived THC beverages are sold like any other grocery or convenience item, no cannabis license required.
- Restricted — sold, but routed through the state’s licensed cannabis market instead of general retail, capped at a lower THC amount than most of the category, or otherwise meaningfully limited.
- Change pending — a law has passed or is actively moving that will change the state’s status on a specific, known date.
- Banned — hemp-derived THC beverages are prohibited or regulated out of practical existence.
- Unclear — our sources are thin or conflicting. We say so rather than guess.
State hemp law has moved fast in both directions over the past two years, and it will keep moving — the full table below shows every state, sourced and dated, and is checked regularly for changes.

What this table can't tell you
- It's legal status, not a shipping guarantee. Whether San Buzi actually ships to your state today is a separate question from whether the law allows it — checkout is the real answer key for that.
- It's a snapshot as of each state's own review date, not a live feed of your state legislature.

Why this keeps changing
Hemp beverages are new enough, and grew fast enough, that most state legislatures wrote their cannabis and alcohol laws before this category existed. Many are actively catching up right now, which is exactly why federal action (see our ban explainer) and state action are moving on separate, sometimes contradictory tracks at the same time.
