We ship to Florida

Florida orders come straight to your door: San Buzi ships its hemp-derived Delta-9 THC lemonade to addresses across the state, from Pensacola to Miami. Choose Strawberry Lemonade, Blueberry Lemonade or the 24-can Mixed Case. Every 12 oz can has 10mg Delta-9 THC and 5mg CBG, with zero alcohol and zero calories.

In Florida the 21+ rule is state law as well as our policy. Section 581.217 of the Florida Statutes bars selling ingestible hemp extract to anyone under 21, and a violation is a misdemeanor. Only adults 21 and older can order.

Florida THC drink law, in plain terms

As of October 12, 2026, hemp THC drinks in Florida are governed by section 581.217 of the Florida Statutes, the state hemp program, and FDACS Rule 5K-4.034. The Florida Department of Agriculture and Consumer Services (FDACS) regulates hemp extract meant for human consumption as a food. No Florida statute or rule bans online sales or home delivery, but Rule 5K-4.034(8)(b) says hemp extract may not be mailed, shipped or otherwise delivered to a purchaser unless the seller first confirms the purchaser is 21 or older, and FDACS says all hemp extract "distributed from or sold in Florida must comply with Florida law."

Florida does not limit THC by milligrams per can or per serving. Instead the statute sets a concentration limit: hemp extract may contain no more than 0.3% total delta-9 THC on a wet-weight basis. By our own arithmetic, 10mg in a 12 oz (355 mL) drink comes to about 0.003%, a small fraction of that limit.

The statute also sets product rules for hemp extract sold in Florida. It requires a certificate of analysis from an independent testing lab, a label that includes a scannable code linked to the batch COA, a batch number, an expiration date and the milligrams of each marketed cannabinoid per serving, and packaging that is not attractive to children and meets the federal Poison Prevention Packaging Act standard, which FDACS describes as child-resistant. FDACS guidance says a standard single-serving tab-top aluminum can will generally meet that standard, though any modification to the can may result in a finding that it is not child resistant.

Section 581.217 was last amended in 2023. The 2026 session's hemp bills died when it ended on March 13, 2026, including SB 1270 ("Food and Hemp Products"), which died in committee, and HB 1409 ("THC"). The bigger date is federal. As of October 12, 2026, a federal cap of 0.4mg total THC per container is scheduled to take effect December 11, 2026 (P.L. 119-103 delayed it from November 12, 2026), and Florida's statute does not shield anyone from it.

What applies when you order from Florida

  • You must be 21 or older. Florida law prohibits selling ingestible hemp extract to anyone under 21, and Florida's hemp rule bars shipping or delivering it until the buyer's age (21+) is confirmed.
  • Florida has no per-can milligram cap. Its limit is 0.3% total delta-9 THC by wet weight.
  • Florida requires hemp extract sold in the state to have a certificate of analysis from an independent testing laboratory.
  • An adult signature (21+) may be required on delivery, depending on carrier and destination.

As of October 12, 2026, most of a new federal hemp definition, including a cap of 0.4mg total THC per container, is scheduled to take effect December 11, 2026, after Congress pushed it back from November 12. It applies in every state. See our explainer on the change.

Florida THC drinks: common questions

Can I order THC drinks online in Florida?

Yes. As of October 12, 2026, no Florida statute or rule bans online sales or home delivery of hemp extract, and San Buzi ships to Florida addresses for adults 21 and older. Florida's hemp rule does require the seller to confirm a buyer is 21 or older before hemp extract is mailed, shipped or delivered, and products sold in the state still have to meet Florida's testing, labeling and packaging rules.

Do I need to be 21 to buy THC drinks in Florida?

Yes. Section 581.217(7)(d) of the Florida Statutes prohibits selling ingestible hemp extract to anyone under 21. An adult signature (21+) may also be required when your order is delivered, depending on carrier and destination.

Is there a THC limit per drink in Florida?

Not in milligrams. Florida caps hemp extract at 0.3% total delta-9 THC on a wet-weight basis, and a 10mg, 12 oz can is far below that concentration. Even so, 10mg is a full dose for many people.

Is Florida changing its hemp drink rules?

Not so far. As of October 12, 2026, the 2026 hemp bills, including SB 1270 and HB 1409, died when the session ended on March 13, 2026, and section 581.217 has not been amended since 2023. Our Florida legal guide covers the background.

Will the December 2026 federal change affect Florida orders?

It could. As of October 12, 2026, the federal hemp definition is scheduled to exclude final products with more than 0.4mg total THC per container starting December 11, 2026. A 10mg can is well above that, and Florida's statute does not override federal law. Our 2026 hemp beverage ban explainer covers what is settled and what is not.
