New Hampshire is a state in transition for hemp THC drinks. As of October 12, 2026, San Buzi ships its Delta-9 THC lemonade there, to adults 21 and older only, and a law signed July 2, 2026 (SB 624) rewrites the state's hemp rules effective January 1, 2027.
This page covers New Hampshire's rule as of October 12, 2026, what SB 624 changes on January 1, 2027, and what it does not do, including the 0.4mg cap some early coverage attributed to it.
New Hampshire THC drink law, now and in 2027
New Hampshire's hemp law is RSA chapter 439-A. As of October 12, 2026, RSA 439-A:4 says nothing in the chapter authorizes the sale of hemp-derived products containing THC 'greater than 0.3 percent on a dry weight basis,' counting delta-8, delta-9 and any other THC isomer. The chapter sets no milligram cap per serving or per container, and as of that date we found no state statute setting a minimum age for hemp THC products; RSA 179:5 III adds one on January 1, 2027.
SB 624, signed July 2, 2026 as 2026 N.H. Laws chapter 275, changes that on January 1, 2027. The 0.3% dry-weight test will count total THC, including THCA, and RSA 439-A:4 will add that over-limit products 'are prohibited.' A new RSA 179:5 III says no 'licensee, salesperson, nor any other person' may sell or give away hemp-derived THC products, in any amount, to anyone under 21. Under a new RSA 179:50 V, also effective January 1, 2027, all liquor licensees must comply with RSA 439-A:4.
News coverage of the House-amended bill in May 2026 described a cap of 0.4mg total THC per container. That cap is not in the enacted chapter 275 text or in the updated RSA 439-A posted by the General Court. The 0.4mg-per-container limit buyers may hear about is federal: a new federal hemp definition that includes it is set to take effect December 11, 2026, in every state, New Hampshire included.
What applies when you order from New Hampshire
- San Buzi sells only to adults 21 and older. New Hampshire's own ban on sales to anyone under 21 (RSA 179:5 III) starts January 1, 2027.
- New Hampshire limits hemp products by concentration, not milligrams: no more than 0.3% THC on a dry-weight basis (RSA 439-A:4).
- From January 1, 2027, that 0.3% test counts total THC, including THCA.
- As of October 12, 2026, New Hampshire's enacted law has no 0.4mg-per-container cap; the federal one is set for December 11, 2026.

What’s changing in December 2026
As of October 12, 2026, most of a new federal hemp definition, including a cap of 0.4mg total THC per container, is scheduled to take effect December 11, 2026, after Congress pushed it back from November 12. It applies in every state. See our explainer on the change.
New Hampshire THC drinks: common questions
Are THC drinks legal in New Hampshire right now?
Within limits, yes. As of October 12, 2026, New Hampshire's hemp chapter draws its line at 0.3% THC on a dry-weight basis (RSA 439-A:4) and sets no milligram cap per can or package.
What changes for THC drinks in New Hampshire on January 1, 2027?
Under SB 624 (2026 N.H. Laws chapter 275), the 0.3% dry-weight test starts counting total THC including THCA, products over that limit become expressly prohibited, and selling or giving hemp THC products to anyone under 21 becomes illegal under RSA 179:5 III.
Did New Hampshire pass a 0.4mg-per-can limit?
No. A House version of SB 624 was reported in May 2026 to include a 0.4mg-per-container cap, but the enacted text and the updated RSA 439-A contain none. The 0.4mg cap set for December 11, 2026 comes from the new federal hemp definition, not New Hampshire law.
How old do you have to be to buy THC drinks in New Hampshire?
San Buzi sells only to adults 21 and older. As of October 12, 2026, we found no New Hampshire statute setting a hemp THC purchase age; RSA 179:5 III makes 21 the legal minimum for sales from January 1, 2027.
Do New Hampshire's 2027 rules penalize buyers or sellers?
RSA 179:5 III is written as a ban on selling or giving these products to people under 21, so it targets whoever makes the sale. Citizens Count reports that the House removed penalties for individuals under 21 from SB 624 and focused on fining businesses that sell illegal hemp products.
