Oklahoma's state rules for hemp THC drinks are short. As of October 12, 2026, the state's hemp regulator holds products to 0.3% total THC, and we found no state per-can cap, no seller license and no statutory minimum age. As of October 12, 2026, San Buzi ships its 10mg Delta-9 THC lemonade to Oklahoma adults 21 and older from Atlanta.

Lawmakers tried to change those rules in 2026, and the Oklahoma Department of Agriculture, Food, and Forestry has said which products will no longer count as hemp once the federal hemp definition changes, a change now set for December 11, 2026. Both are covered below.

Oklahoma THC drink law, in plain terms

Oklahoma's hemp program is run by the Oklahoma Department of Agriculture, Food, and Forestry (ODAFF). In a January 16, 2026 letter, ODAFF said that under current law hemp products may test at no more than 0.3% total THC, a figure that counts THC plus 87.7% of THCA. As of October 12, 2026, we found no Oklahoma statute or rule that sets a milligram cap per serving or per can, requires a license to sell hemp beverages, restricts online or delivered sales, or sets a minimum purchase age.

The 2026 session took up a cap, an age limit and licensing. HB 4248, an under-21 ban on hemp beverages, passed the House 94-1 and the Senate 45-0, but the official record shows it was recalled from enrollment with no governor's action. SB 3, which would have adopted the federal 0.4mg-per-container limit while letting hemp beverages with up to 10mg of total THC per container be sold to adults 21 and older in licensed package stores, passed the House with amendments on April 29, 2026, and the record shows no final passage. SB 2092, which would have put hemp beverages under the ABLE Commission with sales by licensed retailers, stalled after its second reading in February. As of October 12, 2026, none had become law.

ODAFF's letter also looks ahead: once the new federal hemp definition applies, it says, a final hemp product must contain no more than 0.4 milligrams of total THC per container, and products over that limit 'are not considered hemp and cannot be marketed as such.' The letter was written before Congress delayed the federal change; under P.L. 119-103 it is now set for December 11, 2026.

What’s changing in December 2026

As of October 12, 2026, most of a new federal hemp definition, including a cap of 0.4mg total THC per container, is scheduled to take effect December 11, 2026, after Congress pushed it back from November 12. It applies in every state. See our explainer on the change.

Not in state statute as of October 12, 2026. HB 4248, an under-21 ban on hemp beverages, passed both chambers in 2026 but was recalled from enrollment and never signed. San Buzi sells only to adults 21 and older.
