We ship to New Mexico

You may have read that New Mexico caps hemp THC at 2mg a serving. That limit is real, but NMED describes its hemp rule as applying to facilities operating in New Mexico, so it governs hemp products made or handled at New Mexico-permitted facilities. As of October 12, 2026, San Buzi ships its 10mg Delta-9 THC lemonade into the state from Atlanta, to adults 21 and older.

Here is what New Mexico's hemp rule covers as of October 12, 2026, what it leaves out, and where our reading is an inference rather than an official ruling.

New Mexico THC drink law, in plain terms

In New Mexico, hemp manufacturing is regulated by the New Mexico Environment Department (NMED), through its Cannabis and Hemp Bureau, under 20.10.2 NMAC. The Hemp Final Rule took effect January 28, 2026, making an August 2025 emergency rule permanent. It keeps the 0.30% total-THC limit and, from March 28, 2026 (60 days after the rule took effect), caps hemp finished products at 2.0mg total THC per serving and 20mg per package (20.10.2.12 NMAC). Tinctures (100mg per package) and broad-spectrum products (6.0mg per package) have their own limits, and vapes and cosmetics have no milligram limit.

The same rule says a New Mexico hemp facility 'shall not receive, possess, manufacture, offer, advertise, market, or sell' synthetic or semi-synthetic cannabinoids (20.10.2.11(K) NMAC), except that it may use nine listed ones, such as CBD and CBG, at 98% purity or higher (20.10.2.11(L)). The ban applies by its terms to New Mexico hemp facilities -- extraction, manufacturing, warehouse and retail-manufacturer operations -- and NMED describes the whole rule, including the cap, as applying to facilities operating in New Mexico and the products they make. NMED says the rule 'applies to extraction, manufacturing, warehouse, and retail facilities operating in NM,' and its August 2025 fact sheet describes the synthetic ban as closing 'the federal loophole for products manufactured in New Mexico.'

As of October 12, 2026, we found no New Mexico statute or rule that bans, licenses or registers an out-of-state seller shipping finished hemp drinks to New Mexico adults, and no statewide minimum age for hemp products. That the 2mg cap stops at New Mexico facilities is our reading of NMED's own scope statements; we found no NMED statement that addresses remote sellers directly. A 2025 bill that would have regulated hemp retailers, HB 346, passed both chambers but died, so it is not law.

We ship statewide, including Albuquerque, Las Cruces, Rio Rancho, Santa Fe, Roswell, Farmington, Hobbs, Clovis, Carlsbad and Alamogordo. Details are on our shipping page.

New Mexico THC drinks: common questions

Can I buy THC drinks online in New Mexico?

Doesn't New Mexico limit hemp THC drinks to 2mg?

For products made at New Mexico-permitted hemp facilities, yes: since March 28, 2026, 20.10.2.12 NMAC has capped them at 2.0mg total THC per serving and 20mg per package. NMED's scope statements tie the cap to facilities operating in New Mexico, and we found nothing extending it to a seller with no New Mexico facility; that is our reading, not an NMED ruling.

What is the age limit for THC drinks in New Mexico?

We found no statewide hemp age minimum as of October 12, 2026. San Buzi sells only to adults 21 and older everywhere, including New Mexico.

Why are New Mexico-made hemp drinks lower in THC than San Buzi?

New Mexico hemp manufacturers must stay within 2.0mg total THC per serving and 20mg per package under NMED's final rule. A San Buzi can is made in Atlanta and has 10mg Delta-9 THC.

Is New Mexico changing its hemp rules?

As of October 12, 2026, we found no enacted New Mexico change with a future effective date. HB 346 (2025), which would have regulated hemp retailers, passed both chambers but died; the federal hemp definition change set for December 11, 2026 applies in every state.
