As of October 12, 2026, Maine's hemp statute sets no milligram cap and bars selling potentially intoxicating hemp products, a category that includes Delta-9 THC drinks, to anyone under 21, and San Buzi ships its Delta-9 THC lemonade there from Atlanta to adults 21 and older. Every can is Strawberry Lemonade or Blueberry Lemonade with 10mg Delta-9 THC and 5mg CBG, and no alcohol or calories.

Maine's core hemp law is one statute section, 7 M.R.S. section 2231. Below is what it says about age, potency and packaging as of October 12, 2026, plus one phrase in it that could matter when the federal hemp definition changes in December.

Maine THC drink law, in plain terms

Maine's hemp rules sit in 7 M.R.S. section 2231. Since June 2025, when LD 1920 became law as an emergency measure (Public Law 2025, chapter 416), section 2231(12) has said a 'potentially intoxicating hemp product' may not be sold to anyone under 21. Delta-9 THC is on the statute's list of potentially intoxicating cannabinoids, and a product leaves that category only if, in final form, it has both less than 0.3% of those cannabinoids and more than 10 parts nonintoxicating cannabinoids to 1 part intoxicating ones. A can with 10mg Delta-9 THC and 5mg CBG does not meet that ratio, so the age rule covers it.

As of October 12, 2026, section 2231 sets no milligram limit per serving or per container. Its potency line is in the definition of hemp itself: no more than 0.3% delta-9 THC, measured on a dry-weight basis for the plant and its extracts and in final form for food, drinks and other ingestible products, 'or as otherwise defined in federal law.' Beverages are expressly exempt from the section's child-resistant packaging requirement (2231(13)(A)), and 2231(13)(B) bars labeling or packaging that violates federal trademark law or would cause a reasonable consumer to confuse the item with a different trademarked product. The state hemp program at the Department of Agriculture, Conservation and Forestry says it does not regulate hemp processing, and its program page lists no beverage-specific rule.

That 'federal law' phrase is worth watching. A new federal hemp definition, including a 0.4mg total-THC-per-container limit, is set to take effect December 11, 2026. Because Maine's definition points to federal law, our reading of the text is that Maine's own definition may follow the federal one; as of October 12, 2026, Maine had issued no guidance on the question.

Maine THC drinks: common questions

Can adults legally buy THC drinks in Maine?

Yes. As of October 12, 2026, Maine permits hemp products that meet its hemp definition and sets the purchase age at 21 under 7 M.R.S. section 2231(12). The statute has no milligram cap per can.

What is the minimum age to buy THC drinks in Maine?

21. LD 1920, in effect since June 2025, made it illegal to sell a potentially intoxicating hemp product to anyone under 21, and Delta-9 THC is one of the cannabinoids that puts a product in that category. San Buzi sells only to adults 21 and older.

Does Maine cap how much THC a drink can contain?

Not in milligrams. As of October 12, 2026, 7 M.R.S. section 2231 has no per-serving or per-container cap; its only potency limit is the 0.3% delta-9 THC figure in the definition of hemp, which for food and drink products is measured in their final form.

Do THC drinks need child-resistant packaging in Maine?

No. Maine's hemp statute has a child-resistant packaging requirement, but section 2231(13)(A) expressly exempts beverages. Labeling and packaging still may not violate federal trademark law or make a reasonable consumer think the item is a different trademarked product (section 2231(13)(B)).

Will the December 2026 federal change affect Maine?

The new federal hemp definition, with its 0.4mg total-THC-per-container cap, is set to apply in every state from December 11, 2026. Maine's own definition of hemp also refers to federal law ('or as otherwise defined in federal law'), so the state definition may follow it; that is our reading of the text, and Maine had issued no guidance as of October 12, 2026.
