Is Delta-9 Legal in Alabama? THC Drinks, 2026 Guide
Short answer: yes, with restrictions. Alabama regulates hemp-derived THC beverages through its Alcoholic Beverage Control Board, with a per-serving cap, a license and bond for retailers, and a short list of who's allowed to sell. Here's the actual rule, what it requires, and what it means for a can of San Buzi.

Quick Answer
Yes, with restrictions. Hemp-derived Delta-9 THC beverages are legal in Alabama under HB 445, which moved consumable hemp under the state’s Alcoholic Beverage Control (ABC) Board. Beverages are capped at 10mg THC per serving, buyers must be 21 or older, and they can only be sold by licensed hemp dispensaries or grocery stores -- not convenience stores. The law has been fully enforceable since January 2026.
What Alabama’s rule actually says
HB 445, signed by Gov. Ivey on May 27, 2025 and in effect since July 1, 2025, shifted regulation of consumable hemp (including THC beverages) to Alabama’s ABC Board. ABC Board enforcement began January 1, 2026. The beverage requirements:
- A per-serving cap: no more than 10mg THC per serving.
- Container limits: 12 fl oz max container size, and no more than 4 containers per carton.
- 21+ only: sales are limited to adults 21 and older.
- A limited set of sellers: only hemp dispensaries and grocery stores may sell beverages. Convenience stores are excluded entirely.
- A licensed, bonded retailer: a $1,000 ABC license fee plus a $25,000 surety bond per retail location.
- Independent lab testing: with a scannable COA.
- Packaging: child-resistant packaging and no kid-appealing imagery.
- No online sales or shipping: Section 28-12-60(a) says “Online sales, direct delivery, drive-through sales, and direct shipments of consumable hemp products within or into this state are strictly prohibited.” A first violation is a Class A misdemeanor.
What that means for a can of San Buzi
San Buzi is made in Atlanta: 10mg Delta-9 THC and 5mg CBG per 12 oz can, zero alcohol, zero calories. Alabama’s cap is 10mg THC per serving with a 12 fl oz maximum container. Every San Buzi lot has its own public Certificate of Analysis, which is the easiest way to confirm what any can actually contains (and here’s how to read one).

What could change
- At the state level: Alabama’s framework is new. HB 445 was signed May 27, 2025, took effect July 1, 2025, and the ABC Board’s enforcement began January 1, 2026. The rules above are what’s in effect today.
- At the federal level: a new federal hemp definition capping finished products at 0.4mg total THC per container takes effect December 11, 2026, and Alabama law doesn’t shield anyone from that. See our explainer on the 2026 hemp beverage ban.
