Is Delta-9 Legal in New Jersey? THC Drinks, 2026 Guide
Short answer: only through certain licensed New Jersey sellers, and not online, according to the state's Cannabis Regulatory Commission. Online retail sale of intoxicating hemp beverages has been illegal in New Jersey since January 13, 2026, and under the law as of October 7, 2026, the licensee sales window closes November 13, 2026, a date that may move. Here's the actual rule, what it means for shipping, and what could change.

Quick Answer
Only through certain licensed sellers, and not online. Since April 13, 2026, only certain New Jersey liquor licensees and Cannabis Regulatory Commission (CRC) licensees may sell intoxicating hemp beverages (hemp-derived THC drinks), and only until the licensee window closes; in-store signs must say only a person 21 or older may buy them. Online retail sale of them -- direct-to-consumer shipping included -- has been illegal since January 13, 2026, so San Buzi does not ship to New Jersey. Under the law as of October 7, 2026, the licensee window closes November 13, 2026 (a date that may move), after which the CRC says drinks over 0.4mg total THC per container are cannabis, sellable only by licensed cannabis retailers.
What New Jersey’s rule actually says
New Jersey’s framework is P.L.2025, c.215 (S4509), approved January 12, 2026 and in effect since January 13, 2026, as amended by P.L.2026, c.7 (S3945/A4791, approved March 30, 2026), which moved the beverage potency limit’s start date from April 13 to May 31, 2026, and by P.L.2026, c.13 (A5051/S4297, approved May 29, 2026). The New Jersey Cannabis Regulatory Commission publishes an FAQ on intoxicating hemp-derived products, though it dates from April 2026 and predates c.13. Under the law as of October 7, 2026:
- No online sales: N.J.S.A. 2C:35-10f(b) makes it unlawful to sell, offer for sale, or distribute any intoxicating hemp beverage or hemp-derived cannabinoid product through online retail sale; under 2C:35-10f(d)(1), violations carry the same criminal penalties as marijuana under N.J.S.2C:35-5. The ban has been in effect since January 13, 2026 and has no end date. The statute does not define online retail sale; law-firm alerts read it to cover direct-to-consumer shipping.
- No vending machines: vending-machine sales are banned too.
- Licensed sellers only: since April 13, 2026, and until the licensee window closes, only licensed sellers may sell them. Under 2C:35-10g(a) and section 11 of c.215, as amended by P.L.2026, c.13, those are New Jersey plenary wholesale and plenary retail distribution licensees, CRC licensees and, since May 29, 2026, certain plenary retail consumption (bar) licensees -- not those in hotels, restaurants, entertainment venues or bowling alleys. Anyone else who sells them faces penalties.
- 21+ only: P.L.2026, c.13 requires in-store signage stating the drinks may only be purchased by a person 21 years of age or older.
- Two allowed formats: since May 31, 2026, a beverage must be either a can with not more than 10mg total THC (no per-serving cap) or a resealable 750 mL bottle of 40 servings of 5mg each, with a 90-110% lab-testing tolerance. P.L.2026, c.13 replaced the earlier 5mg-per-serving / 10mg-per-container rule.
- A scheduled cutoff: the licensee window closes November 13, 2026 (a date that may move; see below), and from then any sale of an intoxicating hemp beverage by anyone is penalized. After it closes, the CRC says drinks over 0.4mg total THC per container are cannabis, sellable only by licensed Class 5 cannabis retailers (it dates this November 14).
The online-sale ban’s text has no in-state limit. As of October 7, 2026, no statute, CRC guidance or enforcement action addressed out-of-state shippers, so its reach to them is a strong inference from the text rather than an express rule.
What that means for a can of San Buzi
San Buzi is made in Atlanta with 10mg hemp-derived Delta-9 THC and 5mg CBG per 12 oz can, zero alcohol, zero calories. Every lot has a public Certificate of Analysis (and here’s how to read one). On potency alone, a 10mg can sits within the format New Jersey licensees may sell while the licensee window is open (a can with not more than 10mg total THC). Potency isn’t the issue for shipping, though: New Jersey bans online retail sale of intoxicating hemp beverages, direct-to-consumer shipping included, and limits in-state sales to the licensees listed above until that window closes.
Where to buy THC drinks in New Jersey
In-state, intoxicating hemp beverages can be sold only by the New Jersey liquor licensees and CRC licensees described above, and only until the licensee window closes. The CRC lists selling these beverages online among the things the law immediately prohibits, and vending-machine sales are banned.

What could change
- At the state level: as of October 7, 2026, the November 13, 2026 date could still move. P.L.2025, c.215 ties the licensee window’s expiry to the federal hemp redefinition, most of which P.L. 119-103 delayed to December 11, 2026, but 2C:35-10g(a)(2) also names November 13 directly, so whether the federal delay moves it without new legislation is unclear. As of October 7, 2026, S4635/A5604 (introduced October 1, 2026) was pending; it would extend the licensee sales window to December 11, 2026 or the later federal date, and trade press reported that it would leave the online-sale ban unchanged. The CRC dates the cannabis reclassification November 14.
- At the federal level: P.L. 119-103 delayed most of the new federal hemp definition to December 11, 2026, leaving some provisions with a November 12, 2026 effective date. For what the new definition means for hemp THC drinks, see our explainer on the 2026 hemp beverage ban.
