Is Delta-9 Legal in Georgia? THC Drinks, 2026 Guide
Short answer: yes. Georgia is one of the clearer states in the country for hemp-derived THC beverages -- a specific per-can cap, a licensing system, and sales at regular retail. Here's the actual rule, what it requires, and what's been proposed to change it.

Quick Answer
Yes. Hemp-derived Delta-9 THC beverages are legal at general retail across Georgia under SB 494 and GAC Rule 40-32-5-.06. Each 12 fl. oz. container is capped at 10mg total Delta-9 THC, buyers must be 21 or older, and the seller must hold a state Retail Consumable Hemp Establishment License. No medical card or dispensary is involved.
What Georgia’s rule actually says
SB 494, signed by Gov. Kemp on April 30, 2024 and in effect since October 1, 2024, set up Georgia’s consumable hemp framework. The beverage-specific requirements live in GAC Rule 40-32-5-.06, administered by the Georgia Department of Agriculture:
- A hard per-can cap: no more than 10mg total Delta-9 THC per 12 fl. oz. container.
- 21+ only: sales are limited to adults 21 and older.
- A licensed seller: retailers need a Retail Consumable Hemp Establishment License from the Georgia Department of Agriculture.
- Real lab testing: a full-panel Certificate of Analysis from an ISO-accredited lab, publicly accessible through the label or a QR code.
- Packaging and labeling: child-resistant packaging and a Department-approved warning label.
- No alcohol: hemp-derived THC can’t be combined with alcohol in a single product.

What that means for a can of San Buzi
San Buzi is made in Atlanta and dosed right at Georgia’s cap: 10mg Delta-9 THC and 5mg CBG per 12 oz can, zero alcohol, with no headroom to go higher. Every San Buzi lot has its own public Certificate of Analysis, which is the easiest way to confirm what any can actually contains (and here’s how to read one).

What could change
- At the state level: a 2026 Senate study committee on intoxicating cannabinoids in consumable hemp has been reviewing further rules. Two bills that would have tightened beverages (SB 33 and SB 254) were discussed but did not pass before the session adjourned. The rule above is what’s in effect today.
- At the federal level: a new federal hemp definition capping finished products at 0.4mg total THC per container takes effect December 11, 2026, and Georgia law doesn’t shield anyone from that. See our explainer on the 2026 hemp beverage ban.
