House Passes Bill Delaying Federal Hemp THC Ban to December 11 — Now Awaits Trump’s Signature

A federal deadline that would have banned most hemp-derived THC beverages — San Buzi included — just got pushed back a month, pending one final step.

What happened

On September 1, 2026, the House passed H.R. 6500, the Continuing Appropriations and Extensions Act, 2027, on a 370-48 vote under suspension of the rules. Tucked into that short-term government funding bill is a one-month delay of the new federal hemp definition — pushing its effective date from November 12 to December 11, 2026. The Senate had already passed the same delay on August 8. The bill now goes to President Trump’s desk. The White House has said it supports the delay and that his advisers would recommend he sign it, but as of this writing, he has not yet signed it.

Why it matters

The new definition comes from Section 781 of the Continuing Appropriations and Extensions Act, 2026 — a provision enacted back in November 2025. It caps a finished hemp product at 0.4mg of total THC per container, versus the 0.3%-by-dry-weight standard that’s let an entire category of hemp-derived THC drinks (San Buzi included) exist since the 2018 Farm Bill. At 0.4mg, essentially no real hemp beverage on the market today — ours included, at 10mg per can — would still qualify as legal hemp once the new definition takes effect.

The one-month delay doesn’t change that outcome on its own. It buys the industry more time to lobby for a different fix — most notably the Beverage Regulatory Parity Act (H.R. 10079), introduced August 10 by Reps. Beth Van Duyne (R-TX) and Greg Landsman (D-OH), which would regulate hemp beverages like alcohol instead of banning them outright. That bill hasn’t had a floor vote.

Where things stand

• The 0.4mg definition is enacted law. It is not yet in effect.
• Both chambers of Congress have now passed a delay to December 11, 2026 (H.R. 6500) — it takes effect once President Trump signs it, which the White House has indicated he’s expected to do.
• The Beverage Regulatory Parity Act would create a real regulated path forward, at a lower dose than most of the category sells today. It hasn’t passed.
• Nothing about ordering from San Buzi changes today.
